Bar Exam Format

Themis currently offers a Wisconsin Bar Review course beginning with the July 2022 exam administration.

Wisconsin administers a two-day bar exam. Day One consists of the Wisconsin Essay Exam. Day Two consists of the 200-question Multistate Bar Exam (MBE).

Wisconsin Essay Exam

The Wisconsin Essay Exam may include parts of the Multistate Essay Examination (MEE) and Multistate Performance Test (MPT), both of which are prepared by the NCBE. It may also include questions prepared by the Wisconsin Board of Bar Examiners.

Essay questions will be drawn from the following subject areas: Agency and Partnership; Business Organizations (Corporations, Partnerships, Associations, and Sole Proprietorships); Civil Procedure (Pleading and Practice, and Jurisdiction of Courts); Commercial Law (including Sales, Secured Transactions, and Negotiable Instruments); Conflicts of Laws; Constitutional Law (Federal); Contracts; Criminal Law & Procedure; Evidence; Family Law (Domestic Relations); Limited Liability Companies; Professional Responsibility (Ethics and Legal Responsibilities of the Profession); Property (includes Real Estate); Taxation (Federal); Torts; and Trusts & Estates.

Multistate Performance Test (MPT)

The MPT consists of one 90-minute item that is designed to assess the examinee’s ability to use fundamental lawyering skills in a realistic situation. Each item includes a “File” of source documents and a “Library” of cases, statutes, and rules. The MPT is a “closed universe” component in that it provides all necessary materials to answer the question and does not require the applicant to use any state-specific law.

Multistate Bar Exam (MBE)

The MBE consists of 200 multiple-choice questions that test the following areas: Civil Procedure, Constitutional Law, Contracts & Sales, Criminal Law & Procedure, Evidence, Real Property, and Torts. Of the 200 questions, 175 are scored questions and 25 are unscored pre-test questions. The pre-test questions are indistinguishable from the scored questions so applicants are advised to answer all questions.

Candidates must achieve a combined score of at least 258 on the MBE and the essay examination to pass the Wisconsin bar exam. The scores of the exam sections are weighted as follows: essay exam 50% and MBE 50%.
