Bar Exam Format

Themis’s Delaware Bar Review course will become available for the July 2026 bar exam.

The Delaware Bar Exam is a two-day exam that is administered on the last Tuesday and Wednesday in February and July. Day One consists of four 45-minute Delaware Essay Exam questions and two 90-minute Multistate Performance Test (MPT®) questions. Day Two consists of the Multistate Bar Exam (MBE).

Delaware Essay Exam

Consists of four 45-minute essay questions that can test on Business Organizations (Delaware Corporations, LLCs, and Limited Partnerships), Civil Procedure (State and Federal, including the Family Court of DE and in the Court of Chancery), Criminal Law & Procedure (including Delaware Criminal Code, provided, however, that the essay questions will not include identification of degree of offense or quantity tiers for drug offenses), Equity, Trusts, Wills & Trusts, plus all MBE subjects. Effective for the July 2026 bar exam, Conflict of Laws, Family Law, Trusts & Estates, and Secured Transactions will no longer be tested on the essay portion of the exam.

Multistate Performance Test (MPT)

The MPT consists of two 90-minute items that are designed to assess the examinee’s ability to use fundamental lawyering skills in a realistic situation. Each examinee receives a “File” of source documents and a “Library” of cases, statutes, and rules. The MPT is a “closed universe” component in that it provides all necessary materials to answer the question and does not require the applicant to use any state-specific law.

Multistate Bar Exam (MBE)

(Weighted 50% of Bar Exam Score)

The MBE consists of 200 multiple-choice questions that test the following areas: Civil Procedure, Constitutional Law, Contracts & Sales, Criminal Law & Procedure, Evidence, Real Property, and Torts. Of the 200 questions, 175 are scored questions and 25 are unscored pre-test questions. The pre-test questions are indistinguishable from the scored questions so applicants are advised to answer all questions.
